Marital agreements, encompassing both prenuptial and postnuptial agreements, have gained increasing significance. When drafting Marital agreements, we must ensure adherence to key procedural safeguards to maximise their chances of being upheld by the courts, including full financial disclosure, independent legal advice for both parties, and execution well in advance of any wedding (for prenuptial agreements). Agreements must be fundamentally fair and meet the parties' reasonable needs, anticipating potential future scenarios, including asset acquisition, inheritance, business ventures, and international elements, while building in review mechanisms for significant life events such as the birth of children or substantial inheritance.
