Children Matters
Arrangements for children following separation require careful consideration. The paramount principle is that the child's welfare must be the primary consideration. When advising clients, we emphasise that while parents may have their own preferences regarding child arrangements, the court will ultimately prioritise what serves the best interests of the child. Key considerations include maintaining meaningful relationships with both parents where safe and appropriate, ensuring minimal disruption to the child's education and routine, and protecting them from any potential harm or conflict. We can advise on matters such as Parental responsibility, Child Arrangements Orders, Specific Issue Orders, and Prohibited Steps Orders, while encouraging parents to reach amicable agreements through mediation where possible, to avoid the emotional and financial costs of contested court proceedings. The court expects parents to attempt mediation through a MIAM (Mediation Information and Assessment Meeting) before litigation, except in cases involving domestic abuse or safeguarding concerns.
