Domestic Abuse
Domestic abuse cases require immediate and careful handling to ensure the safeguarding of the people involved. The Domestic Abuse Act 2021 has broadened the legal definition of abuse to encompass physical, emotional, psychological, economic, and coercive control, providing stronger legal frameworks for protection. When advising clients experiencing domestic abuse, solicitors must conduct risk assessments and consider urgent protective measures such as Non-Molestation Orders and Occupation Orders through the Family Court. These injunctive orders, which can be obtained on an emergency basis without notice to the perpetrator where necessary, provide crucial legal protection. We adopt the trauma-informed approach, requiring us to maintain clear communication while being sensitive to the psychological impact of abuse and ensuring appropriate support services are in place, including signposting to domestic violence support organisations, counselling services, and safe housing providers.
